Terms & Conditions

1. Purpose and Scope

Agence Rose is a real estate agency based in Kinshasa, specializing in the purchase, sale, rental and management of properties for owners and tenants.
These general terms and conditions apply to all services provided by Agence Rose, whether in person, by phone, or through our website.
Any person using our services is deemed to have read, understood and accepted these terms.
The parties acknowledge that real estate transactions are governed by the laws in force in the Democratic Republic of Congo.
In case of any conflict between these terms and a signed contract, the provisions of the specific contract shall prevail.

2. Mandate, Fees and Payments

Any service provided by Agence Rose (sale, rental or property management) is based on a written mandate or formal agreement between the client and the agency.
Agency fees and commissions are agreed in advance and clearly communicated before any transaction.
Unless otherwise stated, agency fees are due upon signature of the deed of sale, lease agreement, or any contract concluded through Agence Rose’s intervention.
Payments are made in US dollars or Congolese francs, according to the exchange rate agreed at the time of the transaction.
In case of late or non-payment, Agence Rose reserves the right to suspend its services and take appropriate action to recover any outstanding amounts, in accordance with Congolese law.

3. Client Obligations and Accuracy of Information

The client (owner, buyer or tenant) undertakes to provide Agence Rose with accurate, complete and up‑to‑date information about the property or their personal situation.
The owner guarantees that they are legally entitled to sell or rent the property and that it is free from undisclosed encumbrances.
The buyer or tenant acknowledges that it is their responsibility to verify that the property meets their requirements (size, location, use, permits, etc.).
Agence Rose cannot be held liable for any false statements or major omissions made by a client.
Any significant change (price, availability, condition of the property) must be communicated to the agency without delay.

4. Liability, Claims and Governing Law

Agence Rose acts as an intermediary and makes every effort to secure transactions but does not guarantee the successful completion of a sale or rental.
The agency’s liability can only be engaged in case of proven fault and is limited to the amount of the fees received for the service concerned.
Any complaint must be submitted in writing to the agency within a reasonable period after the issue is discovered.
By using our services, the client agrees that any dispute shall be governed by the laws of the Democratic Republic of Congo and, where necessary, submitted to the competent courts of Kinshasa.

5. Confidentiality and Data Protection

Agence Rose undertakes to handle all information received from its clients as confidential and to use it only within the scope of providing real estate services.
Personal data collected (contact details, ID documents, property information) are kept in line with common practices in the Democratic Republic of Congo and only for as long as necessary to manage the files.
Except where required by law or by competent authorities, no information will be shared with third parties without the client’s consent.
The client is responsible for the confidentiality of communications carried out through their own devices and channels (phone, e‑mail, messaging apps).
By using our services, the client agrees that certain exchanges may be recorded or archived for follow‑up, security, or as evidence in case of a dispute.
